Risk Management System (RMS) in Imports -

Attention
of all Importers, Custom House Agents (CHA) and members of the Trade is invited
to the Board's Circular No.42/2005 & 43/2005 -
Cus. both dated 24.11.2005 on Risk Management System (RMS) and Accredited
Clients' Program (ACP) respectively and Public Notice No.68/2006 dated
26.05.2006 issued by this Commissionerate wherein the procedures for clearance
of Bills of entry under Indian Customs EDI system (ICES) after introduction of
RMS were detailed. In addition to the said procedures, the trading public is
advised to take note of the following:-
1. FOC Charges: The trade is advised to voluntarily ask for ‘FIRST CHECK’ in cases of imports involving goods having invoices shown as ‘NCV (No Commercial Value)’ or ‘Value for Customs purposes’ or ‘Supplied Free of Charge (FOC)’.
2.
Data Quality: The
trade is advised to mention Anti Dumping Duty Notification No. and date, in
addition to the details mentioned in para 14 of the said Public Notice viz.
'DATA QUALITY'. Any non-declaration or mis-declaration in this regard is liable
to be viewed seriously and consequential action could be initiated against the
importer/CHA according to law.

Post Clearance Audit (PCA): Para
13 of Public Notice 68/2006 dated 26.05.2006 prescribes issue of consultative
letter setting out the grounds for the auditor’s view in the matter and
seeking the importer’s response thereto.
The trade is advised that the importer’s reply is expected in a
reasonable time and in any case not later than 30 days.
They are also informed that undue delay in responding to the consultative
letter may lead to non-facilitation of future imports by the Risk Management
System (RMS).
